Scope of general terms and conditions
These general terms and conditions apply to all purchase agreements that AviRings Auction concludes with the buyer on behalf of a seller of one or more pigeons. These general terms and conditions also apply to all contracts for services that AviRings Derby concludes with the sellers of one or more pigeons.
By registering on the AviRings Auctions website, you also agree to the validity of these general terms and conditions.
It is not possible to complete such registration without agreeing to the validity of these terms and conditions.
Website AviRings Auctions
AviRings Auctions has carefully composed the content and design of its website. In addition, AVIRINGS Auctions takes care of as much as possible to update and supplement the scope of its website and prevent irregularities or inaccuracies. Despite the care taken by AVIRINGS Auctions, it is possible that this content is not current or contains irregularities or inaccuracies. AVIRINGS Auctions expressly declares itself not liable for any damage that is or could be a consequence of this.
AVIRINGS Auctions is also not liable for the content and security of websites referred to on its website. Users of the AVIRINGS Auctions website are liable for what they send - whether or not authorized - to other persons or entities using this website. The information mentioned in the auctions comes from private sellers, breeding centers, intermediaries, intermediaries, or contact persons of associations. These persons are solely responsible for the correctness And the completeness of this information. Should damage arise as a result of the information displayed due to incorrect assuming that it is correct or complete, then the persons or entities that have provided this information incorrectly or incompletely are liable for this and not AVIRINGS Auctions.
If a user of the website logs in or registers and thus creates an account, he is responsible for managing his data, such as the username and password. This user must exercise due care and keep his password secret from third parties. If third parties place bids on auction objects on the AVIRINGS Auctions website via the username and password of the user above and win an auction as a result, this user is obliged to pay the purchase price, as he is responsible for this. The user must then personally address the third party who has misused his data to be able to recover his damage.
AVIRINGS Auctions is in no way liable for the above-written use of the data of the user of the website unless there is gross negligence/carelessness on the part of AVIRINGS Auctions.
AVIRINGS Auctions can regularly send information about the relevant purchase or assignment agreement to the other party’s e-mail address. The other party is obliged to regularly collect this mail sent to the e-mail address provided as the contact address to AVIRINGS Auctions. If the other party has a new electronic contact address, it must be adjusted immediately. If the other party is negligent or fails to provide this contact information, it will be entirely at its own expense.
Auction regulations for the seller: In case pigeons are auctioned by AVIRINGS Auctions; the following should be done:
- Prior to an internet or room auction, the pedigrees must be present at the offices of AVIRINGS by email or post.
- When the pedigrees are approved, a date for sale is agreed upon with the seller. An appointment is then made to take pictures of the pigeons.
- During the photoshooting, the pigeons are checked. The seller must supply a vaccination document. AVIRINGS Auctions refuse pigeons that have a poor build or health. After the pigeons have been inspected and photographed, they usually wait until the auction’s end in the AviRings loft capacities.
- The seller is asked to submit a fully completed list with ring numbers/gender/colour in order to avoid inaccuracies with regard to genders and the like.
- Sellers are fully responsible for providing correct and complete information regarding the pigeons to be auctioned. Should any damage arise due to incorrect or incomplete information provided by the seller, then the seller is fully liable for the damage that is or could be the result of this. All additional details about breeding or flight data must be supplied digitally. This also applies to other photo materials.
- If the pigeons have not been successfully auctioned, they will be delivered back. If this is not possible, the new deal must be consulted with AVIRINGS.
- If at any time it appears that the pigeons offered for sale or the pigeons auctioned are not vaccinated or are not healthy, AVIRINGS Auctions has the right to declare the sale null and void. However, the seller must pay all costs incurred – expenses and brokerage fees – to AVIRINGS Auctions. Should these pigeons cause damage due to their poor health on the part of AVIRINGS Auctions or third parties, the seller of these pigeons is liable for this consequential damage.
Auction regulations for the buyer: If a buyer has purchased an auctioned object, the following applies:
- AviRings does not guarantee the correctness of the gender disclosure for the young birds without a DNK certificate.
- An auctioned object is sold in the condition it is in at the time of purchase. If the buyer receives the auction object, he must carefully examine it for health. If there are problems, this must be reported to AVIRINGS Auctions within 3 weeks, as the auction objects are living creatures whose condition is subject to change. Issues that are reported to AVIRINGS Auctions later than 3 weeks will no longer be considered and are excluded from any compensation for the damage by AVIRINGS Auctions. The above does not apply if the pigeons have been quarantined.
- if the buyer has won an auction because he has made the highest bid and the auction has been closed, he is obliged to purchase the auction object. However, the buyer only becomes the owner of the offered sales price that has been paid in full to AVIRINGS Auctions or the seller. The payment term for this is 8 days.
- if the buyer, for whatever reason, does not decide to pay the purchase price, he is fully responsible for the damage suffered by the seller or AVIRINGS Auctions as a result. In that case, AVIRINGS Auctions is also entitled to sell the auction object to another person on behalf of the seller
- the purchased auction objects are transported to the buyer no later than 14 days after AVIRINGS Auctions or the seller has received the purchase amount. This is except for countries to which quarantine periods apply.
Pedigrees pigeons
- AVIRINGS Auctions is not responsible for the content of the pedigrees. The seller must complete these pedigrees in good faith.
Storage and transport of pigeons
If AVIRINGS Auctions stables the pigeons or arranges for their transport to the buyer, the following applies:- AVIRINGS Auction stores the pigeons at AviRings loft as careful professional owner, providing the pigeons with more than standard conditions regarding accommodation, food, and veterinarian services. In the case of the sudden death of the pigeon/pigeons or if the pigeon/pigeons are lost; the AVIRINGS auction repays the damage to the seller in the average selling amount of concrete auction or according to the agreement with the seller.
- If AVIRINGS Auctions stores the pigeons at AviRings loft, for less than 30 days, this does not apply any additional costs.
- AVIRINGS Auction transports appear under international rules (Trace certificate, etc.), fulfilling the standard conditions for animal transport.
Changes to general terms and conditions
These general terms and conditions can be changed by AVIRINGS Auctions at any time. If this is the case, AVIRINGS Auctions will publish the new version of these general terms and conditions on the homepage and make it approachable for other parties. The other party must then respond within a period of 30 days whether these new general terms and conditions are accepted by him or whether he rejects them. If no response is given, this will be regarded as an acceptance of the new general terms and conditions by the other party. In the event of rejection, the agreement to which these general terms and conditions apply will be dissolved with immediate effect. A written confirmation of this acceptance or rejection will be given to the other party by AVIRINGS Auctions.
